Wills
In addition to our family law practice, the Law Office of Gary L. Nichols, PLLC assists clients with the preparation of simple wills. We assist you by meeting with you to discuss your goals and objectives, examining your assets and determining if you need a will, and then determining if a simple will is sufficient for your estate and your needs. If your needs require more in-depth estate planning, we can refer you to an experienced attorney who can meet your needs. If a simple will instrument will properly meet your needs, we can assist you in preparing the appropriate documentation according to the Texas Probate Code.Â
Probate
Probate is the court supervised process where the court oversees the administration of a deceased person's estate, to ensure that any final bills and expenses are paid, including any taxes owed; and any assets remaining are distributed to the beneficiaries named in a will; or if the decedent died intestate (without a will), any assets remaining are distributed to the correct heirs under the Texas laws governing intestate distribution. Â
Texas law imposes a four-year probate period following a person's death. It is important to complete probate within this period, or it becomes a much more complex, expensive, and time-consuming process.Â
